Outdoor Dining and Takeout Alcoholic Drinks

Ch. 88 of the Acts of 2024, a supplemental appropriations bill, contains two important changes to outdoor dining and takeout of alcoholic beverages. Section 4 amends the Zoning Act, G.L. c. 40A, to authorize the Select Board or Mayor to allow licensed premises to expand outdoor table service, including alcohol service, effective immediately upon filing of approval with the Town or City Clerk. Section 10 provides that an establishment that sells alcohol for on-premises consumption may sell for takeout mixed alcoholic drinks with takeout food, so long as they are in sealed containers.
